Small Surface-Discharging Wastewater Treatment Systems

Regardless of their size, wastewater treatment systems that discharge directly (via pipe) or indirectly (via ditches, swales, tiles, etc.) to surface waters such as lakes, rivers, streams, wetlands, and coastal waters are required to have permit coverage under the National Pollutant Discharge Elimination System, as authorized under Section 402 of the Clean Water Act.

Currently, hundreds of thousands of homes across the nation utilize individual treatment systems which indirectly discharge to surface waters. Some states have developed general and/or individual NPDES permit programs for these so-called "discharging systems," but other states have improperly allowed these systems under state or local health department regulations.
